Illinois prohibits the use of AI to provide mental health and therapeutic decision-making

The Illinois Governor signed into law last week The Wellness and Oversight for Psychological Resources Act which prohibits the use of AI to provide mental health and therapeutic decision-making, but allows the use of AI for administrative and supplementary support services for licensed behavioral health professionals. It will be interesting to see how this plays out, as it runs against the current administration’s interest to “lessen the burden of bureaucratic restrictions and to build effective policies and processes for the timely deployment of AI.” But more immediately, this Illinois act could run counter to FDA’s current final guidance on clinical decision support software (CDSS), which allows for “…supporting or providing recommendations to a health care professional about prevention, diagnosis, or treatment of a disease or condition.” In response, Ash Therapy is not currently available in Illinois until more clarity on this bill is available.
